Booking Confirmation

Your booking is confirmed once the booking deposit shown on your quote or invoice has been received. The remaining course balance must be paid by the due date stated on your invoice and before training commences.

Booking Deposits

Except where otherwise required by Australian Consumer Law, your booking deposit may be retained if:

• you cancel your booking;
• you fail to attend your scheduled training without prior agreement;
• you do not pay the remaining course balance by the invoice due date;
• you are unable to attend because of personal circumstances; or
• Clarke’s Heavy Vehicle Licensing has already incurred reasonable costs in preparing for or reserving your training.

The deposit reserves your training date and contributes towards administration, scheduling, preparation and the cost of holding that training place for you.

Outstanding Course Balance

If the remaining balance is not paid by the invoice due date, Clarke’s Heavy Vehicle Licensing may cancel the booking. Where a booking is cancelled because payment was not received by the due date, the booking deposit may be retained to cover reasonable costs and losses associated with reserving the training date.

Rescheduling

We understand that unexpected circumstances can arise. Requests to reschedule must be made as early as possible. Where sufficient notice is provided, Clarke’s Heavy Vehicle Licensing may, at its discretion, transfer your booking to another available training date.

Rescheduling is subject to availability. An additional fee may apply where a training date or vehicle was reserved specifically for you, preparation or administration has already been completed, third-party costs have been incurred, or insufficient notice is provided.

Failure to Attend

If you do not attend your scheduled training and have not made a prior arrangement with Clarke’s Heavy Vehicle Licensing, your booking may be cancelled. Your booking deposit may be retained, and additional payment may be required before another training date can be booked.

Cancellation or Postponement by Clarke’s Heavy Vehicle Licensing

Training may occasionally need to be cancelled or postponed because of trainer illness, vehicle or mechanical issues, unsafe weather or road conditions, regulatory requirements, or circumstances outside our reasonable control.

Where Clarke’s Heavy Vehicle Licensing cancels a course and cannot provide the booked service, you will be offered either:

• a transfer to another suitable training date; or
• a refund of the amount paid for the cancelled training.

Clarke’s Heavy Vehicle Licensing is not responsible for indirect expenses such as accommodation, travel, lost income or other personal arrangements, except where required by law.

Australian Consumer Law

Nothing in this policy excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law. Services provided by Clarke’s Heavy Vehicle Licensing come with consumer guarantees that cannot be excluded.

Depending on the circumstances, you may be entitled to a remedy where services are not provided with due care and skill, are not fit for an agreed purpose, are not provided within an agreed or reasonable time, or experience a major failure.
